OCALA, FL (352today.com) – A request from the Wall-Rives American Legion Post no. 58 regarding a special use permit that would allow for a year-round outdoor community flea market in an area zoned community business will be heard Sept. 29 by the Marion County Planning and Zoning Board.
The site is a 1.69-acre parcel located at 10730 S. Hwy. 41 in Dunnellon, just north of the City of Dunnellon, is in the secondary springs’ protection zone and is in the unincorporated area of Marion County.
Marion County staff has recommended approval with conditions. Those conditions are being imposed to address the compliance with the requirements of the land development code. Staff hasn’t received any letter of opposition. The applicant is listed at Wall-Rives American Legion Post no. 58 Post Commander Carl Kester.
The special use permit would allow for multiple seasonal, civic and military remembrance events as well as a monthly weekend flea market, without the need for acquisition for the need of a special event permit. The county’s special use permit mechanism has limitations in place for one event per quarter. The flea market operations will be limited to once per month for a total of twelve per year.
The Special Use Permit will expire October 21, 2030; however, it may be renewed administratively for 5-year periods up to 3 consecutive times by a written instrument signed and issued by the growth services director. However, renewal may be denied if there are unresolved violations, complaints by neighboring property owners to Marion County enforcement, zoning or a similar department or if the growth services director determines that renewal should be considered by the board of county commissioners.
The community business classification according to Marion County, provides for shopping and limited-service needs of several neighborhoods, a community, or a substantial land area.
